The Pirate Bay Welcomes Its 4 Millionth User

Despite the numerous lawsuits that have been targeted at The Pirate Bay, the notorious BitTorrent site welcomed its 4 millionth user last weekend.

Founded in 2003, the initial goal of the Pirate Bay founders was to build the first Scandinavian BitTorrent community. Due to the enormous international interest in the (former) tracker the operators of the site changed their initial plans and made the site available in multiple languages a year after it was launched.

Ten filmmakers everyone should be thankful for

In the spirit of the holidays,
it seems appropriate to give thanks for the filmmakers that have touched so many lives with their work. So without wasting any more time, here are ten filmmakers everyone should be thankful for.

1. Stanley Kubrick
The most simple and succinct way to put this is when you ask great filmmakers who the best filmmaker ever was or is, 99 times out of 100, the name they will utter is Stanley Kubrick. He simply reinvented the art form time and time again, always pushing the limits both in subject matter and technically with the tools of his craft. To thank Kubrick for all he has done would take more space than is available here, but probably his most important contribution was his unwavering vision and his relentless desire to carry it out his way or not at all.

Advantages of an LLC

Before doing anything else, producers of independent films should consider WHY they need an LLC.

There are advantages to having a Limited Liability Company tax status. This status is pretty new, since most states have only begun recognizing it since around 1999. Owners of an LLC are referred to as members.

Limited Liability Companies have caught on rapidly since they offer the advantages of very flexible tax treatment, versatility and simple operation, and they offer the most tax liability insulation.

For these reasons the LLC status has become a favorite of small business owners, particularly attorneys. Single member Limited Liability Companies had been barred in some states, but now all fifty states recognize the legitimacy of single owner Limited Liability Companies. No tax is paid when you transfer a sole proprietorship into an LLC.

To start a Limited Liability Company, you must register with your state's office of the Secretary of State and pay a fee to file an article of organization. Articles of organization are generally easy to file and require only the very basic information about your business, such as its name, location, and what it does.

There are fee-based websites that will set everything up for you for the cost of the filing fee, plus their services. There are also instructional books and software available to help you file an article of organization on your own. Fees for the service can run around $150, while state filing fees start at about $50 and can go above $500, depending on the state and the circumstances.

WE REGRET TO INFORM YOU...

...we didn’t get into Sundance.

We weren’t expecting to, but it was still disappointing to get that email. According to the Sundance rejection letter, there were 9800 entries this year. Out of those, a mere 200 films were selected.

Every independent filmmaker dreams their movie will premiere at Sundance. They imagine going to Park City, answering questions from the audience, getting interviewed by entertainment journalists, attending the parties, and selling their movie in an all-out bidding war. So when you get that rejection email, that dream is officially dead.

The worst part is, you start questioning the quality of your movie. You start wondering if one more edit might have improved the film tenfold. If casting name actors would have made a difference. If, God forbid, your little movie is simply not as good as you thought it was.

The Korean film industry imploded in 2006. With too many films in production (so many movies were being that cameras had to be borrowed from Japan) and too many bloated star vehicles hitting the market, the Korean film industry production bubble popped like a subprime mortgage crisis. But in late 2008 and 2009, hope was restored when a series of low budget, independent Korean movies became massive word-of-mouth hits. For the next eight weeks, the Korean Cultural Service will introduce these movies to America.

TUESDAY, JANUARY 12 @ 7pm
DAY TIME DRINKING (2008, 116 minutes, New York Premiere)
One of the rudest things you can do in Korea is turn down a drink. It¹s like spitting in someone¹s face. DAYTIME DRINKING is a rapidly escalating farce that tweaks the humiliation-meter up and up and up and up as Hyuk-Jin, newly broken up with his girlfriend, finds himself bullied into drinking an infinite amount of soju in a series of progressively more surreal situations. The debut film from Noh Young-Seok, Drinking became a word-of-mouth hit in Korea and has played dozens of film festivals around the world. With a vibe somewhere between Jim Jarmusch¹s Stranger than Paradise and Broken Lizard¹s Beerfest the only thing dry about this flick is its humor.

Considered one of the most intellectually ambitious of Korea¹s current crop of indie features, this film¹s lush visuals and caustic performances hide the fact that it was shot for pennies. Flashbacks show the wounded innocents who grew up to become these monsters and as they flay the skin from their faces with their barbed words, the movie gradually darkens and deepens into something much more profound than a simple family snit fit.

First timer Juhn Jai-Hong took an unfinished screenplay by his mentor, Kim Ki-Duk (The Isle, Bad Guy), and turned it into this insane slice of grand guignol social critique that sends up Korea¹s obsession with plastic surgery with a side helping of maximum carnage. Kim is a pretty young woman often mistaken for an actress. Men are always hitting on her, and she's uncomfortable being the object of their sexual fantasies. Her discomfort deepens when she's attacked by a stalker who thinks he's in love with her, and then the cops accuse her of leading the guy on by looking sexy. Together, these two battered souls form an unlikely alliance against the world. Lauded by the New York Times as one of this year's real finds, Breathless will hurt you in all the right ways.

Sorry, Rupert Murdoch-CONTENT Will Remain FREE

Here Are the Facts:

Last week Rupert Murdoch, in a Wall Street Journal Op-Ed, once again proclaimed the advertising business model dead and the era of free content over.

No one doubts that Murdoch is an astute business man. He has made a fortune in media, much of it in tabloids and by cozying up to dictatorships in countries such as China and Russia. He cynically titled the piece that he published in his own newspaper to further his business interests, ”Journalism and Freedom.”

Generally speaking, I’m a fan of Murdoch. They say, “you can’t argue with success” and I usually don’t. However, in this latest episode his reasoning is so divorced from the facts that I have my doubts as to whether he’s really serious.

The dominant trend today is actually toward greater media diversity.

Indie Spotlight: The Graduates

Writer and Director Ryan Gielen calls his film THE GRADUATES, “a love letter to Ocean City,” but it could just as easily be a love letter to that month in every graduate’s life when they don’t know whether they’re still in high school or already in college.

That adolescent Purgatory can be a difficult subject, but Gielen and company handle the keg-fueled "endless summer" celebration and ennui with a very capable eye and a budget of $95,000.

NEW MEDIA technology UPDATE

New Media makes many things possible and many of those who still rely on old media are completely oblivious to the changes that will soon affect us all...

See some recent technological advances and know what's coming:


SPRXmobile has launched the world’s first augmented reality browser for mobile phones names Layar. Layar adds realtime digital information on top of the real world seen through a mobile device’s camera. It does not need any use of recognition through images or other objects. Instead it locates it’s position through a combination of camera, compass and GPS.


Google has implemented semi-3D “Smart Navigation,” which makes your virtual walking a lot easier. Your cursor is mapped on a rough 3D model of the scene, with a convincing sense of depth. Just click where you want to go, and Street View takes you there, making the transition with an unexpectedly convincing pseudo-3D effect.
It also works for off-road sights, like storefronts or distant scenery. These items are mapped as well, so if you lead your cursor to, say, the front door of your house, Street View will automatically take you to the best possible viewpoint. The above video explains it all pretty well.


The EU Joint-Action Science and Technology project (JAST) is developing robots that can engage in joint activities with humans or other robots, to complete tasks through teamwork. Their latest demonstration (see video above) shows their progress with a robot that observes and predicts a human working on a project. The robot identifies the components the human is using and the likely result of assembling the components. The robot then assists the human with the work, locating parts as they are needed, and providing them to the human. The idea is to give robot the capacity for "observation and mirroring (resonance)".

Paramount set to finance up to 20 'micro-budget' movies annually

Let's call it the "PARANORMAL EFFECT" and it brings a whole new way for studio producers to see what every indie filmmaker already knows!

It's also "THE BLAIR WITCH PROJECT" all over again! What Artisan Entertainment learned eleven short years ago is finally starting to sink in.

Some of 2009's most profitable movies have been modestly budgeted works that grossed huge multiples of their costs, including "Paranormal Activity," "The Hangover," "District 9" and "The Blind Side." Realizing that these are not flukes and dazzled by the fact that it could gross more than $100 million on a movie that barely cost $15,000 to make, Paramount Pictures is now set to launch a new production wing devoted to films budgeted at less than $100,000. And every other studio will soon follow.

Before You Close That Distribution Deal...!

I was recently on the phone with one of the many producers/directors who called needing a little assistance. We were discussing the negotiation this producer was about to have, with a distributor who was interested in his movie. So we're chatting and I'm rattling off a number of questions this producer needs to ask the distributor.

Question #1:
How many cities does this distributor want to put your movie or documentary into?

Will it be one city, like New York or Los Angeles? Will it be two cities? Will it be ten? Why is this even important to know?

It's important because this will help you gauge the distributor's true interest. And if you've done your due diligence on them...

Every film, in fact matters. They matter because a film is an impossible proposition to begin with. For men it’s the closest they’ll get to giving birth. Lars Von Trier did give birth this year, to his neurotic mini-me, after which he made Antichrist and scared the bejesus out of everyone. Many a filmmaker who isn’t Steven Spielberg will develop nausea, lose weight, become insomniac or just age prematurely in the process of seeing their film to post-production . HAVING GOOD MANAGEMENT...

Remember the Turtles? "Happy Together"?

The Turtles were formed by Mark Volman and Howard Kaylan. They were saxophone players who did whatever was trendy in order to make a living as musicians. All 6 Turtles sang and this is Mark and Howard (circa 1990) as they describe the business side of their music career.

Producing their music turned into a big nightmare and this illustrates more than anything that even the most talented artists need good competent managers who will work with them.

Chinese recreate Tiger Woods crash with computer animation

If this isn't the viral sensation of the Internet by sundown, then the Internet isn't working properly today.

The above video uses computer animation to show two different scenarios that lead to the Tiger Woods car accident. Both are hilarious.

Have you seen SITA? Probably the best 2D animated Indian feature made to date was made in NYC. It’s titled SITA SINGS THE BLUES. Film critic Roger Ebert loved it and raved about it calling it one of the best films of 2008! Every major film festival around the world featured it! How on earth could one person working only with her computer shame Hollywood (and Bollywood) and make one of the best films of 2008 all by herself? Our NY animator friend, Nina Paley, is in a class by herself! Her award winning ultra low-budget animated film, SITA SINGS THE BLUES is available for streaming. REMBRANDT'S J'ACCUSE - This is Peter Greenaway’s rich film essay about Rembrandt's famous painting, The Night Watch. COMMIT – This is probably the most typical 90 minute new media feature film made with a very low-budget. Directed by Mickey Blaine using only two actors and two locations, it was shot by turning the camera on and off three times during two days, just as it was "performed". Isn't that wonderful? No editing required! With the price of everything heading towards zero, the new question is now, "How do you make money when the price of all new media will soon be FREE?"

E-greetings like the one on top of this e-mail are slowly starting to replace traditional greeting cards and we all know how e-mail has taken a bite out of the US Postal Service snail mail. Google has over 200 very high quality applications they offer without charge. Television as we used to know it becomes obsolete as no one wants to wait any longer for the 9:00 movie or the 6:00 or 11:00 news; they want to see it now!

YouTube and Vimeo let you upload important news, interviews, and personal silliness. Craigslist wiped out newspapers’ classified ad sections globally – nearly all printed papers and magazines now totter on the brink of bankruptcy if they fail to make the transition.

Wikipedia has nearly obliterated the venerable and highly respected 240-year-old Encyclopedia Brittanica literally wiping its 20 heavy volumes off all library shelves and the face of the Earth. Skype and Messenger programs have just started to devastate the phone industry with long distance calls almost a thing of the past. 330+ million Internet viewers have made Susan Boyle the most famous woman in the world and as a result, her debut CD has become the most pre-ordered CD in the history of Amazon.com.

Facebook, mySpace, YouTube, LinkedIn (and a host of others including a much smaller one that is discovering the secret) vie for our attention and support while anything and everything is available on the Internet at all times, NOT at your local newsstand, book store, department store, record shop, television, theater or local meeting place. No one wants to wait; instant gratification is the key.

I always thought that there would come a day when someone would astonish us by producing a "new media" 3D feature movie with Elvis, Marilyn Monroe, John Wayne and Bruce Lee, but I now realize that I was wrong. It appears that the first new "new media" film will star John, Paul, George and Ringo but because of his untimely death, another film that could be a contender would star Michael Jackson.

Most do not doubt that 2010 will be much worse economically than 2009. All businesses, except those few, very powerful corporations at the very top are going to struggle in the years ahead. They will try to adjust their pricing, their offers, their products, their services, their hours and everything else in order to keep money flowing in and their doors open.

Almost every "no money-new media" independent film made to date has NOT made money and probably never will make money in the near future as Hollywood maintains its stranglehold on the theaters, TV and cable companies. And as Hollywood begins to fail (MGM is the first to be sold) and change if you want to make money with a new project, you cannot do what everyone who owns a camcorder is doing. You cannot just make "films"...

There is a NEW "new media" concept that will slowly work its way into our lives, changing the way everything is presented. And the person who best understood this and was just starting to explore it (and saw how to use it as a vehicle to make his comeback)...was Michael Jackson.

Incredible as it seems, while searching for an inexpensive way to make realistic special effects, George became the dominating force that has forever changed the entire world and the way we will live in the 21st century. In my humble opinion, he (and not Al Gore) is responsible for the green revolution.
